1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Kohls RCM Pawel Kohls, operating as softnode ("Company," "we," "us," or "our"), registered at Lechicka 59, 61-695 Poznan, Poland, VAT ID: PL5542524133, concerning your access to and use of the softnode.cloud website and our services.
By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access our services.
2. Description of Services
Softnode provides managed hosting for open-source applications. Our services include:
- Managed hosting of Wiki.js, n8n, Uptime Kuma, and other open-source tools
- Automated provisioning and deployment
- Server management, updates, and maintenance
- Custom subdomain and domain support
- Data backups and SSL certificates
3. Account Registration
To access our services, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Subscription and Billing
Our services are offered on a subscription basis. By subscribing to a paid plan, you acknowledge and agree to the following:
- Recurring charges: Your payment method will be automatically charged on a monthly basis at the rate specified at the time of purchase
- Billing cycle: Each billing period is one calendar month from the date of subscription
- Price changes: We may modify pricing with at least 30 days' notice. Continued use after the change constitutes acceptance
- Upgrades: Plan upgrades take effect immediately. The price difference is prorated for the remaining billing period
- Downgrades: Plan downgrades take effect at the end of the current billing period
- Taxes: Prices are exclusive of applicable taxes (VAT). Taxes will be added based on your location
Payments are processed securely by Stripe. We do not store your payment card details on our servers.
5. Cancellation and Refund Policy
You may cancel your subscription at any time through your account dashboard or by contacting us.
- Cancellation: Your service remains active until the end of the current paid billing period. No further charges will be made after cancellation
- Refunds: We do not provide refunds for partial billing periods. If you cancel mid-month, you retain access until the end of that month
- Data retention: After cancellation, your data will be retained for 30 days before permanent deletion. You may request earlier deletion
- Exceptions: If you experience a significant service outage or error on our part, contact us to discuss a prorated credit or refund

6. Acceptable Use Policy
You agree not to use our services to host, store, transmit, or distribute any of the following:
- Illegal content: Any material that violates applicable laws or regulations in your jurisdiction or in Poland/EU
- Child sexual abuse material (CSAM): Any content depicting or promoting the exploitation of minors. This results in immediate account termination and referral to law enforcement without prior notice
- Violence and terrorism: Content that promotes, glorifies, or incites violence, terrorism, or self-harm
- Hate speech: Content that promotes discrimination, hostility, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Pornography and adult content: Sexually explicit material of any kind
- Harassment and threats: Content intended to harass, bully, stalk, or threaten individuals
- Malware and phishing: Software designed to damage, intercept, or gain unauthorized access to systems, or fraudulent websites impersonating other services
- Spam and unsolicited communications: Mass messaging, email harvesting, or any form of unsolicited bulk communications
- Intellectual property infringement: Content that violates copyrights, trademarks, or other intellectual property rights of third parties
- Unauthorized access: Attempting to gain access to other users' accounts, instances, or our internal systems
- Cryptomining: Using our infrastructure for cryptocurrency mining or similar resource-intensive activities not related to the intended service
- Infrastructure abuse: Activities that degrade service quality for other users, including DDoS attacks, excessive resource consumption, or network scanning
We reserve the right to suspend or terminate any account that violates this policy, without prior notice and without refund. In cases involving illegal activity, we will cooperate fully with law enforcement authorities.
7. Monitoring, Logging, and Law Enforcement
To maintain the security and integrity of our platform, we collect and retain the following information:
- Login events: IP address, browser user agent, and timestamp for each login
- Account activity: Instance creation, modification, and deletion events
- Access logs: Server access logs including IP addresses and request metadata
This data is retained for a minimum of 12 months and may be retained longer if required by law.
We will disclose user data to law enforcement authorities when:
- Required by a valid court order, subpoena, or legal process
- We have a good-faith belief that disclosure is necessary to prevent imminent harm, including harm to minors
- Required by applicable law (including EU regulations and Polish law)
We may also proactively report suspected illegal activity — particularly CSAM or terrorism-related content — to the relevant authorities, including NCMEC, Europol, or Polish law enforcement, without notifying the account holder.
8. Account Suspension and Termination
We may suspend or terminate your account and access to our services, with or without notice, for any of the following reasons:
- Violation of these Terms or the Acceptable Use Policy
- Non-payment of subscription fees after the grace period
- Suspected fraudulent or illegal activity
- Request by law enforcement or a government agency
- Extended inactivity (accounts with no login for more than 12 months)
Upon termination for cause (violation of AUP or illegal activity), no refund will be issued and data may be preserved for law enforcement purposes.
9. Intellectual Property
The softnode platform, its design, and branding are the property of Kohls RCM Pawel Kohls. The hosted applications (Wiki.js, n8n, Uptime Kuma, etc.) are open-source software and are subject to their respective licenses.
You retain full ownership of all content you create within your hosted applications.
10. Data and Security
We implement industry-standard security measures to protect your data. Your instances run on isolated infrastructure. We provide automatic backups as part of the service. However, we recommend maintaining your own backups for critical data.
11. Limitation of Liability
To the maximum extent permitted by law, Softnode shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising from these Terms shall be resolved by the courts of competent jurisdiction in Poznan, Poland. For EU consumers, mandatory consumer protection laws of your country of residence may apply.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email and by updating the "Last updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.
